Ritualns Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Ritualns website (the “Site”), including all content, features, and services available on or through the Site—such as browsing our collection of ritual-enhancing products (candles, bath essentials, home décor, etc.), creating an account, or engaging with user-generated content. By accessing or using the Site, you (“User”) agree to be bound by these Terms, as well as our Privacy Policy, Terms of Purchase, and other posted policies (all incorporated herein by reference). If you do not agree to these Terms, you may not access or use the Site.

1. Eligibility to Use the Site

To use the Site, you must meet the following requirements:

Be at least 13 years of age (or the age of majority in your jurisdiction, whichever is older). If you are under the age of majority, you may use the Site only with the explicit consent and supervision of a parent or legal guardian, who will be responsible for your compliance with these Terms.

2.1 Limited License

Ritualns grants you a non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only. This license allows you to:

Browse the Site to view product information, descriptions, and images.
Create a personal account to track orders, save preferences, and streamline future purchases.
Place orders for products for your own use (not for resale or commercial distribution).

This license does not allow you to:

Use the Site for commercial purposes, such as reselling Ritualns products, scraping content for a competitor’s platform, or promoting third-party goods/services without prior written permission.
Modify, copy, reproduce, distribute, transmit, display, perform, or create derivative works of any Site content (e.g., product images, descriptions, logos, brand names, blog posts) without explicit written consent from Ritualns.
Use automated tools (e.g., bots, spiders, scrapers, crawlers) to access, collect, or extract data from the Site—unless you have received written approval from Ritualns.
Attempt to access restricted areas of the Site (e.g., backend databases, admin portals) that are not intended for public use.

2.2 Prohibited Uses

You agree not to use the Site in any way that:

Violates applicable laws, regulations, or third-party rights (e.g., copyright, trademark, privacy, or intellectual property laws).
Is fraudulent, deceptive, or misleading (e.g., creating a fake account, providing false payment information, impersonating another person or entity).
Harms, disrupts, or impairs the Site’s functionality (e.g., uploading malware, viruses, or harmful code; overloading servers; interfering with security features).
Infringes on the privacy, safety, or enjoyment of other Users (e.g., sharing another User’s personal information without consent; sending unsolicited spam, harassment, or abusive content).

Ritualns may take immediate action against any User who engages in prohibited uses, including suspending or terminating account access, blocking IP addresses, removing content, or pursuing legal remedies (including seeking damages) if necessary.

3. Account Management

3.1 Account Creation

If you create a user account on the Site, you are responsible for:

Choosing a secure password and keeping your account credentials (email address and password) confidential. Do not share your password with third parties.
All activities that occur under your account (e.g., orders placed, comments posted, information shared). Ritualns will treat any activity associated with your account as authorized by you.
Notifying Ritualns immediately at [email protected] if you suspect unauthorized access to your account (e.g., unknown orders, changes to your contact information). We will assist you in securing your account, but we are not liable for losses caused by unauthorized use of your account if you fail to protect your credentials.

When creating an account, you agree to provide only truthful, accurate, and complete information. We reserve the right to suspend or delete accounts that contain false or misleading information, or that are inactive for an extended period (e.g., 12 months or more).

3.2 Account Termination

You may delete your account at any time by contacting our customer service team at [email protected] and requesting account closure. Upon deletion, you will lose access to account-specific features (e.g., order history, saved preferences), but we may retain certain data (e.g., order records, payment confirmations) as required by law or for legitimate business purposes (see our Privacy Policy for details).

Ritualns may also terminate or suspend your account without prior notice if:

You violate these Terms or any of our other policies.
We suspect fraudulent or illegal activity associated with your account.
Your account is used to harm or disrupt the Site or other Users.

Upon account termination, all licenses and rights granted to you under these Terms will immediately cease.

4. Intellectual Property Rights

All content on the Site—including but not limited to product images, descriptions, logos, brand names (e.g., “Ritualns”), graphics, text, blog posts, videos, and software—is the exclusive property of Ritualns or its licensors. This content is protected by copyright, trademark, and other intellectual property laws worldwide.

You acknowledge that you do not acquire any ownership rights to the Site or its content by using the Site. Except for the limited license granted in Section 2.1, you may not use, reproduce, distribute, or modify any Site content without prior written permission from Ritualns. Unauthorized use of our intellectual property may result in legal action, including claims for damages and injunctions.

5. User-Generated Content

If you submit content to the Site—such as product reviews, comments, photos of Ritualns products in use, or feedback (“User-Generated Content,” or “UGC”)—you grant Ritualns a non-exclusive, worldwide, perpetual, royalty-free, irrevocable license to use, reproduce, modify, distribute, display, and publish that UGC for any purpose related to the Site or our business (e.g., featuring reviews on product pages, sharing photos on social media, using feedback to improve products).

By submitting UGC, you warrant that:

The UGC is your original work (or you have the legal right to submit it and grant the license above).
The UGC does not violate any laws, regulations, or third-party rights (e.g., no defamatory, obscene, violent, or infringing content; no personal information of others without consent).
The UGC is truthful and accurate (especially for product reviews—we reserve the right to remove reviews that are misleading, spammy, or unrelated to the product).

Ritualns has the right to moderate, edit, or remove any UGC that violates these Terms, is inappropriate, or harms the reputation of our brand—without prior notice to you. We are not liable for any UGC submitted by Users, and we do not endorse the opinions expressed in UGC.

6. Site Availability & Limitations

6.1 Site Availability

We strive to keep the Site available 24/7 for your use, but we do not guarantee that the Site will be uninterrupted, error-free, or free from defects. We may need to temporarily take the Site offline for maintenance, updates, or emergency repairs. When possible, we will notify Users of planned downtime via a notice on the Site or email, but we cannot guarantee advance notice for unplanned outages (e.g., due to server issues or cyberattacks).

Ritualns is not liable for any losses or damages caused by the Site being unavailable, delayed, or interrupted.

6.2 Content Accuracy

While we work to ensure that Site content (e.g., product details, pricing, availability, ingredient lists) is accurate and up-to-date, we do not warrant that such content is error-free, complete, or current. Prices, product specifications, and availability may change without notice. We reserve the right to correct any errors or omissions (e.g., pricing mistakes, typographical errors) and to cancel orders resulting from such errors (see our Terms of Purchase for details).

The Site may contain links to third-party websites (e.g., social media platforms, payment processors). These links are provided for your convenience only—Ritualns does not control or endorse third-party sites, and we are not liable for their content, privacy practices, or services.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Ritualns shall not be liable to you for any direct, indirect, incidental, consequential, special, or punitive damages arising from your access to or use of the Site (or inability to use the Site), including but not limited to:

Damages from lost profits, data, or use.
Harm caused by third-party content, unauthorized access to your account, or UGC.
Errors or omissions in Site content (e.g., incorrect product information leading to a purchase you regret).
Interruptions to Site service or delays in order processing.
Damages related to products purchased on the Site (see our Terms of Purchase and Refund Policy for product-specific liability terms).

Ritualns’ total liability to you for any claims related to the Site or these Terms shall not exceed $100 USD, regardless of the cause of action (e.g., breach of contract, negligence, strict liability). This limitation applies even if Ritualns has been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless Ritualns, its officers, directors, employees, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:

Your use of the Site (or use by someone using your account).
Your violation of these Terms, applicable laws, or third-party rights.
Your submission of UGC (e.g., claims of defamation, infringement, or invasion of privacy related to your UGC).
Your purchase or use of Ritualns products (except to the extent such claims are caused by our negligence or product defects).

Ritualns reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us in defending such matter.

9. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or your use of the Site shall first be resolved through good-faith negotiation with our customer service team. If negotiation fails to resolve the dispute within 30 days, the dispute shall be submitted to binding arbitration in Los Angeles, California, in accordance with the Commercial Arbitration Rules of the American Arbitration Association. Arbitration awards shall be final and binding on both parties, and judgment on the award may be entered in any court of competent jurisdiction.

You agree that you will not bring any class action, collective action, or representative action against Ritualns related to the Site or these Terms. All disputes must be resolved on an individual basis.

10. Changes to These Terms

Ritualns may update these Terms from time to time to reflect changes in our business practices, legal requirements, or Site features (e.g., adding new services, updating privacy compliance). When we make changes, we will revise the “Last Updated” date at the top of this page and post the new version on the Site.

Your continued access to or use of the Site after the changes take effect constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically to stay informed of any updates. If you do not agree to the updated Terms, you must stop using the Site.
